Terms and Conditions
Four Seasons Campers (trading as “Four Seasons by Staycation”) is a trading name of Staycation Scotland Ltd, a company registered in Scotland with company number SC661837, whose registered office is at 8 Park Rd, Dalmuir, Clydebank, G81 3LD.
In these terms and conditions, “Staycation Scotland Ltd,” “we,” “us,” and “our” mean Staycation Scotland Ltd trading as Four Seasons Campers, and “Hirer,” “you,” and “your” mean the person or persons hiring a vehicle from us under these terms.
Payments for your booking are processed by Staycation Scotland Ltd via Worldpay. Your card or bank statement may show the payment under the descriptor “Four Seasons by Staycation.”
1. Minimum Hire
Minimum hire of a campervan is 3 nights unless otherwise agreed, and you can hire our campervans for up to 30 days at a time. If you would like a 2-night hire, we can accommodate this, but you will be charged for 3 nights unless otherwise agreed.
During July and August, there is a minimum hire of 7 nights unless otherwise agreed with us.
2. Passengers
We authorise the use of each vehicle for up to 4 passengers including the driver. Each person must use the safety restraints provided at all times while the vehicle is in motion.
3. Drivers
- Drivers must be between 25 and 75 years old and have held a full licence for a minimum of 2 years.
- A refundable security deposit of £1,500 to cover Campervan Insurance Excess applies to all hires with UK driving licences, and with non-UK licences held within the EU, Canada, USA, Australia, and New Zealand. If your licence is from outside these countries, it will be checked by our underwriters, who will notify us of any additional excess.
- Main drivers must provide photo ID licence prior to hire commencement, plus 2 items of residential proof (2 utility bills from separate companies, less than 3 months old, as required by our insurers). If the driver does not have photo licence ID, the paper licence and a passport are required.
- Additional drivers must provide photo ID licence prior to hire. If they do not have photo licence ID, the paper licence and a passport are required. (They provide the same as the main driver.)
- Details of any additional drivers must be provided in advance of the rental period.
- Drivers are personally liable for all legal penalties (e.g., parking tickets) incurred during the hire period.
- Maximum of 4 drivers per rental.
- All drivers must be present at booking hire start day.
4. Campervan Hire Rates
Hire rates include:
- Unlimited miles in the UK
- UK standard vehicle insurance*
- UK standard equipment & breakdown cover
Additional charge:
- International customers may be charged a currency conversion fee by our payment provider, Worldpay, which is passed directly to them and does not come to Staycation Scotland Ltd.
5. Payment of Your Campervan Rental
- Availability is on a request-and-confirm basis at the time of reservation.
- A reservation is only binding after it has been confirmed by us and a deposit of 25% of the total booking hire fee has been received (or such other deposit as agreed in writing). Our terms and conditions, including our cancellation policy, apply from this point onwards. Once the reservation is confirmed, a confirmation email will be sent to you.
- Settlement of the remaining balance is due 28 days prior to the booking rental start date.
- A refundable security deposit will be held on your preferred payment card (a payment link will be sent to the main driver 3 days before departure) prior to the start of your rental period to cover insurance excess and any damages or road traffic fines incurred. Please note some card issuers do not facilitate holds on cards, in which case your deposit may be charged directly — please check with your card issuer. The security deposit will be released/refunded 7 days after the end of your hire, less any incurred costs for damages and fines.
6. Vehicle Return, Inspection & Late Charges
- You irrevocably authorise us to deduct from the security deposit any amounts due arising out of this agreement. The security deposit will be released/refunded directly to your payment card 7 days after the return of the campervan, provided it is returned to the correct location, undamaged, with a clean interior, and with a full fuel tank.
- The vehicle will be inspected upon its return. To allow a full exterior inspection, the vehicle must be returned in a clean condition. We provide a complimentary exterior car wash (FOC) through a third-party provider for your convenience. If the vehicle is returned dirty, an external inspection cannot be completed at the point of return. In these circumstances, we reserve the right to complete the inspection without you being present and to notify you of any damage identified within 48 hours.
- We reserve the right to retain a £50 fee if the porta-potti is not emptied and cleaned properly prior to return.
- Pick-up and return times will be agreed prior to rental in writing and signed for on your Vehicle Check Sheet, with the following late charges for late returns:
- Up to 30 minutes late: £25
- 30 to 60 minutes late: £50
- 1–2 hours late: £50 plus any additional insurance charges
- Over 2 hours late: daily rental fee plus any additional insurance charges
- To manage bookings effectively, we may change your campervan’s colour and registration, although it will be the same model. Should an accident or damage outside our control mean your campervan model is unavailable, we reserve the right to replace it with an alternative model. All our campervans are short-wheelbase VW campervans, less than 30 months old, with pop-up roofs sleeping 4 people, integrated kitchen, and diesel heating.
7. Cancellation Charges
Our standard cancellation policy applies to holidays taken from 1st April 2022. We recommend customers take out their own travel insurance to cover illness and any related self-isolation regulations, as well as medical cover, while on hire.
- We strongly advise that you take out your own insurance against unavoidable cancellation.
- Should you require to cancel your booking more than six weeks before departure date, a full refund is applicable.
- 6 to 4 weeks: your 25% deposit will be retained.
- If you cancel your booking within 28 days of departure before your departure date, the full amount will be non-refundable.
We reserve the right to cancel your booking should you not meet the following criteria:
- Failure to pay in full 28 days before your departure.
- If any information you have provided us with at booking is incorrect or invalid (e.g., driver’s licence number).
- When collecting a vehicle, all documentation must match the booking details you provided.
8. Rental and Other Charges
You will pay us:
- all rental charges;
- the security deposit held on your card;
- the nominated cancellation fee in the event of cancellation of this agreement prior to acceptance of delivery of the vehicle;
- the cost of any damage to the vehicle or third-party property, subject to insurance*;
- all government fees, duties, parking fines, speeding fines, and congestion charges, including a £15 administration fee added to all penalties handled by us;
- costs relating to any accidents including third-party property damage not reported on return of the vehicle, and associated administration costs;
- any other fees or charges payable under this agreement*;
- the daily rental rate for the period the vehicle is off fleet for accident repairs*;
- the cost to recover a vehicle which has become bogged*.
*This cost is limited to the insurance excess amount, provided all terms and conditions are adhered to. If insurance is deemed invalid due to inappropriate use of the vehicle or breach of these terms, you will be liable for all costs.
9. Payment of Charges — Joint and Several Liability
All charges and expenses payable under this agreement are due on demand. If not paid when due, a late charge of 1.5% per month will apply on the outstanding balance, plus any collection costs including reasonable legal fees. Where the customer comprises more than one person, each is jointly and severally liable for all obligations under this agreement.
10. Campervan Collection and Return
Collection: Please allow up to 1 hour for handover, documentation, and vehicle demonstration.
Airport Collection/Delays: If your flight is delayed, we reserve the right to charge an out-of-hours fee if handover runs outside agreed hours, or to postpone collection/delivery to the following day, subject to staff availability. We will provide a list of suitable accommodation if this happens; the first night will not be refunded as it was unavailable for hire by another customer.
Return: Please allow up to 30 minutes for handover and vehicle condition check on return. The vehicle must be returned with a full tank of fuel, in the same condition as rented, on the date and before the time stated on the rental agreement or Vehicle Check Sheet. You must advise us if delayed for any reason; additional charges may apply.
We will not refund any monies, nor have any obligation to provide a replacement vehicle, if the vehicle is returned or you cease to have use of it prior to the return date for any reason (e.g., accident, weather, theft).
11. Title to Vehicle
We retain title to the vehicle; you possess it as a bailee only. You have no right to pledge our credit in connection with the vehicle and agree not to sell, assign, sublet, lend, pledge, mortgage, or otherwise deal with the vehicle.
12. Use of the Vehicle
You agree the vehicle will not be:
- driven other than in a cautious, prudent, and normal manner;
- used in a manner that could cause damage;
- driven in a prohibited area or an area other than indicated to us;
- driven by a person under the influence of alcohol or drugs, or over the legal blood alcohol limit;
- left with the ignition key inside while unoccupied;
- left unoccupied without the CD faceplate removed and steering wheel lock applied;
- driven by persons under 23 years old or not legally authorised to drive;
- damaged by submersion in water or contact with salt water;
- used for any illegal purpose, race, rally, or contest;
- used to tow any vehicle or trailer;
- used to carry passengers or property for hire or reward;
- used to carry more persons than permitted;
- used to carry volatile liquids, gases, explosives, or corrosive/inflammable material;
- otherwise used in breach of your obligations under this agreement.
13. Alterations to the Vehicle
You shall not make any alterations or additions to the vehicle without our prior written consent.
14. Maintenance
You will take reasonable steps to properly maintain the vehicle, including oil, water, and battery checks. We will reimburse up to £50 for reasonable expenditure rectifying mechanical failure to the drivetrain and engine (excluding water system, refrigerator, heating, audio equipment), provided you produce receipts, obtain our prior consent, and the damage is not due to your fault or breach of this agreement.
You will pay for repair or replacement of tyres* damaged during the rental period and agree to notify us immediately, await confirmation on replacement/repair location, and use the same tyre brand and quality where available. You are liable for costs from incorrect fuel use, including fuel in the water tank or misfuelling the diesel tank.
*For customers who have taken our Premium IDW, tyre damage costs are not chargeable.
15. Responsibility When an Accident Occurs
In the event of any accident, loss, or damage:
- notify us immediately by phone, or by email if contact cannot be made, and await a response before leaving the scene;
- obtain names and addresses of third parties and witnesses, and report to the nearest police station;
- do not make any admission of liability or settlement offer;
- assist us in handling any claim, including providing information and attending court if required;
- the excess or other amount due for damage is payable at the time of reporting the event, not at the end of the rental period;
- you will pay costs relating to delivery of a change-over vehicle as a result of an accident, regardless of fault.
16. Insurance
- We recommend customers take out their own travel insurance to cover illness and medical costs while on hire.
- The vehicle is insured for fully comprehensive cover for damage to the vehicle and third-party property/medical costs, less the excess set by insurers (our insurance does not cover medical costs for hirers).
- The insurance excess is £1,500 as agreed and paid through the security deposit, or another amount agreed by our insurers for higher-risk drivers or licences.
- The security deposit covers the insurance excess and is set against the cost of any damage. You are liable up to the value of the security deposit paid.
- We reserve the right to charge an administration fee in addition to repair costs.
- You will have no insurance cover, and will be responsible for the total cost of any damage, if in breach of any term of this agreement.
- You are responsible for tyre* damage costs, deducted from the security deposit.
- Optional Damage Waiver (IDW) is available to reduce your security deposit and excess:
- Standard IDW — £10/night — reduces security deposit and excess to £750 (windscreen, wing mirror, and tyre excess still apply).
- IDW applies to the first insurance claim only; a second security deposit will be charged at standard rates to continue the rental.
- IDW must be arranged at least one week before hire, before the security deposit is held; it cannot be added after this date.
17. Release and Indemnity
Subject to our obligation to deliver the vehicle, you release Staycation Scotland Ltd, its employees, and agents from liability (regardless of fault) for loss or damage arising from this agreement, including breakdown, mechanical defect, accident, unsuitability for purpose, or loss/damage to property left in or on the vehicle or on our premises. You indemnify us against claims, demands, and expenses arising from your use and/or possession of the vehicle. If we cannot release the vehicle due to a prior accident or fault beyond our control, we will endeavour to provide a replacement or a full refund.
18. Road Restrictions
Vehicles may only be driven on sealed/bitumen roads. We reserve the right to restrict vehicle movements in certain areas due to adverse road or weather conditions or other reasonable cause.
19. Pets
Animals may not be carried without our prior consent. An additional cleaning charge of £40 applies for up to two dogs; the vehicle must be returned reasonably free of pet hair and dirt. We reserve the right to charge a further cleaning fee if reasonable cleaning efforts have not been made.
20. Definitions
- “Staycation Scotland Ltd” / “we” / “us” / “our” — Staycation Scotland Ltd (company number SC661837), registered office 8 Park Rd, Dalmuir, Clydebank, G81 3LD, trading as Four Seasons Campers.
- “Customer” / “you” / “your” — the person(s) named as hirer, and any person whose card is used in payment.
- “Living equipment” — includes but is not limited to TV/DVD player, CD player, crockery, cutlery, cooking utensils.
- “Overhead damage” — damage above 6 feet (1.83m), including from low bridges or height restrictions; not covered by basic insurance or damage waiver, hirer liable in full up to the security deposit amount.
- “Rental period” — the hire period stated on the booking, or any agreed variation, plus any additional period the vehicle remains in the customer’s possession.
- “Vehicle” — the vehicle described on the rental agreement, including tyres, tools, accessories, living equipment, documents, and any replacement provided at our discretion.
- “Security deposit” — the deposit detailed on the rental agreement.
- “Insurance Damage Waiver (IDW)” — the optional cover reducing the hirer’s excess for a first claim.
21. Terminating the Agreement
We may terminate this agreement and repossess the vehicle at any time, without notice, if you breach any term, obtained the vehicle through fraud or misrepresentation, the vehicle appears abandoned, is not returned on the agreed date, or if we reasonably believe your or others’ safety is endangered. You will pay reasonable repossession costs and have no right to a refund in these circumstances.
22. Changes
Any changes to this agreement must be in writing and signed by both parties.
23. Governing Law
This agreement is governed by the law of Scotland.
24. Warranties
You warrant that all information supplied to us in connection with this agreement is true.
25. Entire Agreement
This agreement constitutes the entire agreement between the parties. We reserve the right to add or amend rental charges without prior notice.
